The leader of the 5 Star Movement responded to the government’s choice to block the European proposal which would give the same rights to all children, regardless of the parents’ gender, and to the order to block transcripts at the Milan registry office.
“Let’s not unload the ideological fury of the big ones on the little ones“. The president of the 5 Star Movement Joseph Conte, thus intervened in the debate on the European certificate of filiation. The theme is that of the rights of children of gay couples and more: the EU proposal that the Italian centre-right has rejected – even if a technical error could reopen the discussion – allows for the recognition of the same rights for children in all the countries of the Union, thanks to a single certificate valid everywhere.
This also means that if a person were recognized as a parent in one state, they would also be recognized in the others. From here, thede facto equality in rights among children of heterosexual and homoparental couples.
The excuse of the right: “This opens up to surrogacy”
The Meloni government strongly opposed the measure: “The problem is only one. There surrogacywhich I prefer to call a surrogate uterus“, said the Minister for the Family Eugenia Roccella al Corriere della Sera. Pregnancy for others – this is the technical name of the procedure – is illegal in Italy, as in most European countries.

According to the government, the text of the European proposal would circumvent this ban, obliging children to be registered throughout the EU as long as their certificate is valid in the country where they were born: for example Belgium, Denmark, the Netherlands or Greece, the only European states that allow pregnancy for others. In reality, a passage of the law explicitly states that in order to register children, the laws of the State in question must still be respected.
The most obvious problem for the center-right majority, therefore, remains that of the children of LGBTQ couples. Not surprisingly, the Ministry of the Interior has also ordered the mayor of Milan to stop transcribing children of same-sex parents in the registers of the registry office. A ban with immediate effect, which led to a protest garrison taking place today, March 18th. Also in this case, the motivation reported by the prefect was to block “surrogate motherhood” for couples made up of two men, in addition to heterologous fertilization for female couples.

“The 5 Star Movement will not allow the reactionary discrimination desired by this government to fall on the children of same-parent couples“, wrote Giuseppe Conte in the same post on social media. “The transcription by the municipal authorities, starting from our own Chiara Appendino, who was the leader when she was mayor in Turin, has nothing to do with the legitimization of surrogacy, but it is a act of recognition and protection of the fundamental rights of minors“.
In the past, the Constitutional Court has underlined that the issue of children of same-parent couples was a “priority” and that Italy absolutely had to fill the legislative vacuum on the issue. Today, in fact, the mayors can decide autonomously whether or not to carry out the transcripts – unless a precise ban arrives from above, as in the case of Milan.
As mentioned by Conte, Chiara Appendino she was the first mayor in Italy to register, in 2018. In an interview with Fanpage.it, the former mayor and now a deputy underlined that she had “more than eighty” transcripts and Minister Roccella denied: what she said “it is false, and it is serious that a minister of the Republic lies in this way. Surrogacy has nothing to do with the EU regulation which – I repeat – concerns the rights of children regardless of how they were born or their family unit“, he said.
