At the end of 2021, a Bundeswehr soldier refused the order to be vaccinated against the corona virus. On July 7, 2022, the Federal Administrative Court (BVerwG) confirmed the so-called obligation to tolerate three corona vaccinations for members of the Bundeswehr as legal. As part of a lengthy civil hearing before the District Court of Augsburg, the final judgment in this individual case was made for the time being. To this it says BR 24 illustrative:
“90 daily rates of 50 euros each, plus legal costs: This is the verdict that judge Beate Christ imposed on a 33-year-old in Augsburg on Wednesday (…) According to the judge, the soldier’s superior stated plausibly that the accused aware of all the consequences, decided against vaccination. In doing so, he disobeyed a direct order and was therefore liable to prosecution.”
At the time of his individual decision against the mandatory administration of an mRNA drug, the convict was stationed at a NATO base in Sicily. As part of the verdict, the judge summarized that “the order and the duty to tolerate were not fulfilled by merely appearing at a vaccination appointment”. In addition, the accused “has not made up for the vaccination since then,” according to the judge.
During the course of the hearing, the accused stated that “for fear of vaccination consequences such as heart muscle inflammation, he did not agree to a vaccination”. The article goes on to say:
“An actual vaccination did not come about after the respective information talks. The reasons for this are presented differently by K. (the accused) and the Bundeswehr doctor responsible at the base.”
The accused, who was sentenced to a fine of 4,500 euros and had no criminal record to date, became loud BR 24 “His service has been banned since the beginning of 2022 due to the lack of vaccination”. He was also forbidden to wear his uniform. The defense has announced that it will appeal the verdict.
