Norma Piña dismisses the petition regarding the resignation of Yasmín Esquivel from the SCJN

Mexico.- The president of the Supreme Court of Justice of the Nation (SCJN), Norma Pineapplerejected an application that required the resignation of Minister Yasmín Esquivehim for him plagiarism of your bachelor’s thesis in Law from UNAM.

The petition was presented before the SCJN by Juan Carlos Perez Gongorapresident of the civil association Mexico Fairand in it the resignation of Yasmín Esquivel as minister is demanded as a result of the opinion where the Faculty of Higher Studies (FES) Aragón of the UNAM confirmed the plagiarism.

The document indicates that “the intervention of this High Court is demanded for the purpose of request the immediate resignation of Minister Yasmín Esquivel Mossathe foregoing given the lack of good repute derived from the plagiarism of a degree thesis”, based on article 95 of the Constitution.

The association led by Pérez Góngora, who is the nephew of the former president of the SCJN, Genaro Gongora Pimentelwarns that the presence of the minister “detracts from the work and the figure” of the Court, for which reason “as representatives of the academy, we categorically disqualify the cited acts and We demand your resignation for the good of Mexico“.

Nevertheless, Norma Pineapplewho assumed the presidency of the Court last December, ordered to dismiss the petition based on article 14, section II, first paragraph, of the Organic Law of the Judicial Power of the Federation, considering the doubtful documentsince the México Justo association limited itself to making a call to the ministers without raising any legal representation or judicial litigation.

“In the event that the president deems any procedure doubtful or transcendent, he will designate a minister or rapporteur minister to submit a draft resolution for the consideration of the Supreme Court of Justice of the Nation, so that the latter can determine the procedure that must correspond”, states article 14.

This is the first request submitted to the SCJN where the ministers are called upon to demand the resignation of Yasmín Esquivel after the scandal over the plagiarism of her bachelor’s thesis, although the request has echoed from various sectors of society, including the political class.

After the opinion of the FES Aragón, which confirmed the plagiarism by detecting 90% coincidences between the minister’s thesis and other work, the UNAM fired Professor Martha Rodríguez, who was Esquivel’s adviser.

For his part, the rector of the UNAM, Enrique Graue Wiechers, clarified that they lack the powers to invalidate the title of the minister, but reforms will be promoted to correct said legal gaps, while the Honorary Commission of the University Council will be the one to pronounce in this regard after concluding the review of the opinion of the FES Aragón.
