The European Parliament said this Friday before the General Court of the European Union that the European Parliament has allowed the former president of the Generalitat Carles Puigdemont to access his seat “probably illegally”.

“Parliament has treated the plaintiffs correctly. In January 2020 they were allowed to take a seat in the European Parliament and as we have seen, by a General Court ruling, probably illegally,” said the Eurochamber’s lawyer, Norbert Lorenzin the hearing on the appeal that Puigdemont has filed against the institution for lifting his immunity.

The defense of the former president of the Generalitat, Gonzalo Boye, has argued for his part that the reform of the crime of sedition shows that the pro-independence leader suffers “political persecution” in order to be able to judge him in Spain for the crime. processes.

“My clients want to underline that the proof that we are dealing with a clear case of fumus persecutionis it’s overwhelming,” Boye said.

“It is public and notorious that several important Spanish ministers and the Prime Minister himself, Mr. Sánchez, have been saying in recent days that the change in legislation is to obtain the handover of Mr. Puigdemont to Spain,” Boye stated.

“How many cases do your ladies know of a change in the penal code in a Member State to obtain an extradition? I only know of this one,” continued Puigdemont’s lawyer.

Boye has influenced this argument by saying that both he and Puigdemont “were spied on” with the pegasus programa situation, he said, that the European Parliament “knows about”, since it is analyzing it in the investigation commission that it has created in this regard.

Puigdemont’s lawyer also pointed out that the Supreme Court is not the right one to request the request and accused the European Parliament of not having evaluated whether it was, before lifting the immunity of Puigdemont and the other two JxCat MEPs, Toni Common Y Clara Ponsat.

Boye was the first to intervene in the hearing on the case that will mark the judicial future of the three MEPs.
