The IMI rate of properties located in areas of urban pressure and allocated to local accommodation can be increased by up to 100% of the rate for the year to which the tax relates.

This worsening of the IMI is contained in a proposal to amend the PS to the State Budget for 2023 (OE2023), approved today during the votes in the specialty with the vote against PSD, Chega and Liberal Initiative and the favorable vote of the other parties.

The measure comes in addition to other situations already contemplated in the Code or IMI that allow municipalities that so decide to apply increased rates of Municipal Property Tax.

“Municipalities, by deliberation of the municipal assembly, may define an increase of up to 100% of the rate in force in the year to which the tax to be applied to buildings allocated to local accommodation located in areas of urban pressure, as such defined in a separate diploma” , foresees the proposal now approved.

In practical terms this means that in a municipality where the IMI rate has been fixed, for the year in question, at 0.35%, a local accommodation located in an area and urban pressure will pay 0.7% of IMI, if the municipality does this option and inform the Tax and Customs Authority.

Building in an urban pressure zone

The approved PS proposal also contemplates a reduction — from two to one year — that a building located in an urbanistic pressure zone be considered vacant and, therefore, may be subject to an increase in the IMI rate.

Thus, “urban buildings or autonomous fractions that have been vacant for more than a year, buildings in ruins, as well as land for construction inserted in urban soil and whose qualification in the municipal plan of land use attributes suitability for residential use , whenever they are located in areas of urban pressure”, are subject to an IMI rate which is increased to six times [da taxa de IMI aplicável no ano em causa]being “aggravated, in each subsequent year, by another 10%”.

The IMI rate on urban properties is set annually by the municipalities in a range between 0.3% and 0.45%.
