Deputies from the Frente de Todos (FdT) condemned the expressions of the legislator of Avanza Libertad, José Luis Espert, who called for “prison or bullet” for the tire workers who were demonstrating at the Ministry of Labor, and requested their removal from the lower house . The Human Rights Secretariat, for its part, filed a criminal complaint against him. In parallel, after camping and staying for two days in the offices of the Directorate of Labor Relations, the representatives of the Single Union of Argentine Tire Workers (SUTNA) left the headquarters of the Ministry of Labor at 100 Callao Avenue, at the waiting for the new hearing scheduled for this Monday.
“Criminal Code Art 181, crime of usurpation. Prison (6 months to 3 years) or bullet”, Espert launched on Twitter, in the midst of the joint conflict, the forceful measures of the union and the negotiations with the Government to appease the tension. In this framework, the pro-government legislators repudiated the statement and demanded the dismissal of the legislator from the Lower House. “Enough of violence and threats issued by leaders with institutional responsibilities. We request, under the terms of Art 66 of the CN, the removal of Espert as a national deputy due to moral incapacity,” the head of the FdT bloc, Germán Martínez, said in a statement. , and legislators Paula Pennaca and José Luis Gioja.
Meanwhile, the Secretary of Human Rights criminally denounced Espert for inciting violence, through a presentation by the head of the agency, Horacio Pietragalla Corti, who stated: “As Secretary of Human Rights of the Nation, due to the recent history of our country, and in light of the recent assassination attempt against the Vice President of the Nation, Cristina Fernández de Kirchner, and the context of the proliferation of speeches that incite violence, I find myself obliged to denounce these extremely serious events”.
Espert’s response continued the provocative tone of the original post. To each condemnatory reaction, the deputy replied by citing article 68 of the National Constitution, which establishes that no congressman can be questioned for statements made in the performance of his mandate. However, the Secretariat’s statement says: “It is necessary to emphasize that while Mr. Espert’s statements were not made in the parliamentary sphere and are not related to his parliamentary work, they are not covered by the immunity of opinion guaranteed in the article 68 of the National Constitution”.
In the complaint, which fell to federal court No. 8, in charge of Marcelo Martínez de Giorgi, it is requested that the act be investigated as incitement to violence, a crime defined in article 209 of the Penal Code, which punishes whoever “publicly instigates to commit a specific crime against a person or institution”.

Likewise, in a statement issued on Friday afternoon, they maintained that “all SUTNA action is with a clear objective, which is to resolve this conflict through an agreement that satisfies the fair interests of the workers,” and ratified the transfer of ” the permanence in the ministry and the camp on Callao avenue at the entrance of each of the factories, to repel the provocations of the bosses at the gates and make the conflict visible”.
The resumption of negotiations was achieved after Labor authorities communicated with the Sutna delegates who remained in the offices on Callao Avenue, to assure them that the parties will continue discussing the increase pending review from last year. The tire workers had rejected the 16 percent proposal, in addition to the 50 closed last year.
