Perez Esquivel: "The participation of the people is necessary in requesting a political trial from the Court"

The Nobel Peace Prize winner Adolfo Pérez Esquivel called for popular mobilization for Congress to approve a political trial against the members of the Supreme Court of Justice and joined the voices that warn of political persecution by a sector of the Judiciary against some leaders. “There are attempts at lawfare in our country”he warned.

“The participation of the people in requesting a political trial from the Supreme Court of Justice” is necessary, pointed out the human rights leader, who also confirmed that he is “working a lot” on this issue in the United Nations Organization (UN).

The impeachment request to the Court

Pérez Esquivel’s reference to one of the main problems of the Judiciary was aimed at support the presentation that the American Association of Jurists (AAJ) made in the Chamber of Deputies to initiate a trial process against Carlos Rozenkrantz, Horacio Rosatti, Ricardo Lorenzetti and Juan Carlos Maqueda.

The organization accuses them of “bad performance” in the performance of their duties and having violated “the exercise of rights” guaranteed by the National Constitution “for all the country’s inhabitants”.

“There are judges on the Supreme Court who entered through the window”

There are judges in the Supreme Court who entered through the window and not through the doorwho were appointed by hand without any consultation during the macrismo and who, logically, are conditioned by politics”, said the Nobel Prize winner in reference to Rozenkrantz and Rosatti, who before being appointed by the Senate had agreed to take on those positions by unconstitutional decree of former President Mauricio Macri.

Also, “The Court has not been renewed and has a deficit of women representatives”added as an aggravating circumstance.

Nevertheless, Pérez Esquivel recognized the difficulty that the Chamber of Deputies add the necessary number of legislators to initiate a case against the four ministers, especially since they have the political support of the opposition of Together for Change.

Against this, the only viable alternative is that there be a “participation of the people in requesting a political trial from the Supreme Court of Justice”as happened with other issues that were reversed despite the formal disadvantages, such as the annulment of the 2×1 benefit for those convicted of crimes against humanity.

There were several cases that “were able to repeal thanks to the presence, militancy and struggle of the people”. Therefore, prosecuting the members of the highest court “is not just a decision of the government. We have conquered many things through the great mobilizations”.

The important thing is to have protagonism, presence and construction of democracy. Democracy is not given away, it is built, and we have to strengthen it, if we are not lost”, he considered.

Lawfare and covert coups

In this sense compared what happens in Argentina with what happened in other countrieswhere a sector of the Justice, the media and parliamentary majorities prosecuted progressive political leaders.

With lawfare, covert coups have been provoked. It happened in Paraguay, Honduras, Bolivia and Brazil. And there are attempts in our country”, he warned and pointed to the Supreme Court as one of the vertices of these initiatives.

Pérez Esquivel denounced that “the peoples have remained as spectators” of processes of this type and, therefore, assured that he is “working a lot on the situation in the United Nations”.

As he said, popular mobilization is the only way to counteract the immobilization in which some other political factors are found. “We delegate power to those who govern us, but these afterwards do not do what corresponds but what interests them”, he questioned. That is why “the peoples have to be protagonists”.

“These delegative democracies today are in crisis, so we have to aim at building participatory democracies” and one of the ways is through “the participation of the people in requesting a political trial from the Supreme Court of Justice”he concluded.
