The Government approves the law that prevents carriers from working at a loss

A three-week carrier strike and several months of tough negotiations later there is already a royal decree law that includes one of the most demanded demands by the sector. We are talking about measures so that road freight carriers do not work at a loss and that have been approved in the Council of Ministers held this Monday afternoon.

Within this, it will be included the obligation that the transport contract with the effective carrier (the first contractor) be in writing and reflect the price, which must be equal to or greater than the costs. “This is the only way to check if this price is fair,” say sources from the Ministry of Transport, Mobility and Urban Agenda.

This will be applied in contracts of continued transport. That means that the contracts of the self-employed with other companies are taken into account. In case these measures are not complied with, a sanctioning regime will be included with infractions and sanctions of up to 4,000 euros.

A code of good practices on subcontracting levels and intermediary conditions is also included. In this sense, the Executive assumes the commitment that in six months it will verify if the measures are being complied with and present a bill on contracting.

In this way, the Government incorporates the inspiring principles of the Food Chain Law into the regulations for the transport of goods by road. Something that the sector had been demanding for many months and that has been negotiated in several meetings.

In fact, until two weeks ago there was no agreement. The National Committee for Road Transport (CNTC) rejected and urged the Ministry of Transport to modify the draft.

On the other hand, the direct aid agreed in March and extended to compensate for the effects of the war, which translated into direct aid for transport by type of vehicle, are included. As novelties, moving trucks and urban buses are added.

Thus, an approved package of measures worth 450 million euros in aid by type of vehicle. In this way, the Government will grant 1,250 euros per truck, 950 euros per bus, 500 euros per van and ambulance and 300 euros per light vehicle, that is, to taxis and VTC.

Aid for urban buses is one of the novelties of this Royal Decree Law with respect to the package approved in March and is aimed at companies that provide collective urban or suburban public services.

Of the more than 450 million euros, 12 million euros are reserved for this type of vehicle. Another novelty is that taxis licensed to operate in Ceuta and Melilla will also be eligible for the funds. As for rail transport, a maximum of 1.9 million euros will be allocated to public and private companies.

The agreed aid will be granted before December 31, 2022, respecting in any case the Decisions approved in accordance with the European Temporary Framework Ukraine and its successive modifications.
