The prosecutor Jose Aguero Iturbe asked the Court of Cassation to annul the dismissal dictated to the former president Mauricio Macri and to the members of the then leadership of the Federal Intelligence Agency (IPA) in the case for illegal espionage to relatives ofl ARA San Juan. He also stated that the judges “cannot arbitrarily” close the investigation.

He called the resolution “arbitrary” and said that “contrary to what was pointed out by the judges in the appealed, and as I have argued repeatedly before a complaint of institutional significance, judges cannot arbitrarily close it“.

“Complaints of this institutional gravity must be investigated, it does not matter if the accused is called Juan, Pedro, Cristina or Mauricio. For this reason, I file this appeal and request that the decision taken be annulled,” he added in the opinion.

In mid-July, the Federal Chamber of Buenos Aires dismissed Macri and the leadership of the AFI in the case for the alleged espionage of relatives of the ARA San Juan. As they argued, the elements did not constitute a case of espionage on a group of victims but tasks to guarantee the security of the then president.

The espionage case of the ARA San Juan

On October 1 of last year, Bava called Macri for investigation in the case of espionage on the families of ARA San Juan. On December 1, the aforementioned judge issued his indictment.
