The Minister of the General Secretariat of the Presidency, Giorgio Jackson, seeks in Congress the support that will allow him to advance with the proposal that allows the presence of the armed forces in emergency situations, without this meaning the suspension of the constitutional rights of the people, such as the right to assembly and free movement.

The initiative that would moderate the scope of the current State of Constitutional Exception, known as the “Intermediate State”, seeks to be discussed in the mixed commission where the critical infrastructure project is debated and which was already rejected in the past by Jackson himself and the current President Gabriel Boric, in addition to the spokeswoman for La Moneda, Camila Vallejo, when the three of you were deputies.

Asked about the issue, Jackson indicated that there are substantive differences between the initiative that they voted against and the idea that they seek to legislate now.

“I think that it will be possible to understand when we present the articles the significant differences with respect to the project that was voted on at the time and that we believe the articles speak for themselves once we enter it. The main criticisms often had to do with the breadth of the powers to be able to invoke it and in this case it will be quite specific, in addition to having other democratic safeguards so that this does not mean limitations to the fundamental rights of the people”, indicated the Minister of the Segpres.

One of the aspects that Jackson delved into was that “unlike the States of Exception, what we want is to be able to attend with the help of the Armed Forces. in some situations that are critical, very serious for, we insist, the free transit or supply of the population or for the transfer of emergency vehicles without affecting the fundamental rights that the Constitution ensures.

Regarding the proposed constitutional norm promoted in the Constituent Convention regarding the Armed Forces. they will only be able to act in the event of an external threat, Jackson indicated that these are issues that must be evaluated once the Fundamental Charter initiative is approved in the September plebiscite.

“They are processes that go in parallel, they are different. It is now up to us to exercise all the powers so that we can have safety and free transit on the routes that we saw stopped for several hours, for several days in the episodes in recent weeks, “he said.

During the day, the Secretary of State met with parliamentarians from the National Renewal caucus, who expressed their arguments before expressing their support or rejection of the proposal that the Executive seeks to install.

Miguel Mellado, deputy for the Araucanía Region, indicated that although they valued the Government’s willingness to advance in this matter, “it is very important that what is written in that substitute indication that is in the mixed, is very important for the final result so that it serves or does not serve that intermediate state for the truckers, for the forestry contractors and also for the farmers”.

“We are willing to support this good drafting project. We hope that this will be endorsed later because it is very important for the Region of Araucanía and Arauco that there be soldiers guarding public roads. People are asking for it,” added the legislator.

For his part, Deputy Miguel Ángel Becker commented that the situation in Araucanía and the Province of Arauco could even generate food shortages due to the difficulties faced by farmers.

Regarding the proposal, he specified that “it would be a very good sign for what is happening in the area today. The truth is that today we farmers are very concerned because we are not going to be able to sow under these conditions, also regarding inputs, regarding the uncertainty we have today and that is very serious for food supply.”
