Supreme denies habeas corpus to mother of Henry Borel

Justice Edson Fachin acknowledged that there was no irregularity in the defendant’s arrest

The teacher Monique Medeiros, accused of participating in the murder of her son, the little one Henry Borel, in March of this year, will remain in prison following a decision taken by the minister Edson Fachin, do Supreme Federal Court (STF). Monique’s defense was trying to get a habeas corpus alleging that there were alleged irregularities in the course of her arrest, without her having had adequate regulatory time to participate in the custody hearing. However, Fachin understood that there was no wrongdoing. Monique and former Rio de Janeiro councilor Dr. Jairinho have been imprisoned since April 2021, he in the Bangu Complex, in the west of the capital, and she in a unit dedicated to women. They are defendants in the Rio de Janeiro justice system for triple qualified homicide with the right to torture, for an unjust motive and without the victim’s right to defend himself. In December, there will be the second round of hearings on the Henry Borel case. It will be the Rio Justice’s turn to hear the defense witnesses, who act in favor of the defendants.
