The unions call for the resignation of the Podemos deputy sentenced to jail for kicking a policeman

The police kick Alberto Rodriguez has sent a letter to the Bureau of the Congress of Deputies, after being sentenced to one month and 15 days in prison for assaulting a police officer, in which he assures that he has already paid the fine imposed by the judge. On October 7, Chamber II of the Supreme Court sentenced the podemita to one month and 15 days in prison as the author of the crime of attacking agents of the authority. This prison sentence was replaced by a fine of 540 euros, as well as another 50 euros that the Rastas from Podemos he had to pay the attacked policeman, as well as the costs. The second part of the sentence disables Rodríguez from exercising the right of passive suffrage during the time of the sentence, that is, 45 days.

This Wednesday the deputy of Podemos has sent a letter to the Board of the Congress of Deputies in which he assures that: “I request that the Board of Congress have submitted in writing along with its copy and attached documents -justifying bank transfers- , make use of admitting all this and take it for granted full serving of sentence put by the Supreme Court ».

This maneuver of podemita is precisely due to a part of the sentence that he does not cite in his letter: the disqualification from passive suffrage. The sentence indicates that Alberto Rodríguez will be disqualified for the duration of the sentence. So, the deputy of Podemos intends to show that with the payment of the fine and the costs, he has served his sentence and, therefore, should not be disqualified.

Alberto Rodríguez anticipates the Board’s decision in this way and places it in a complicated position. By having to decide on the disqualification of suffrage for a position for which he has already been elected and with the condition that the podemita shows that he has complied with the part of the sentence that corresponds.

On the 12th, OKDIARIO published that PSOE and Podemos were preparing a trap to free Rastas from disqualification and that he can keep his seat. The two partners of the social-communist government wanted to temporarily suspend the Podemos government during the sentence stipulated in the sentence, in this way the sentence would be considered completed.

The disqualification should entail the delivery of the act, since thanks to that passive suffrage he accedes to the post of deputy, according to the jurists consulted, among others, by the PP.

But Podemos and PSOE are not willing for Rodríguez to leave the post of deputy. And this, despite the pressure exerted by police unions that consider it inadmissible that a public official convicted of attacking the State Security Forces and Bodies can continue in his position.
