Deputies call for 'popular pressure' around the discussion of the 2nd instance prison

The PEC’s rapporteur and author have good expectations regarding its analysis, but fear that the project will be shelved if the public does not insist on the matter

Deputies pressure, but Second instance PEC should not be approved this year by the Chamber of Deputies. The project has already passed through the CCJ of the Chamber and now needs the approval of the special commission, before going to the plenary. Parliamentarians want to change the understanding of the STF, from 2019, in which convicted only serve sentence after the final decision, that is, imprisonment is decreed after all possibilities of appeal have been exhausted. Before, in 2016, the Supreme Court itself assessed that the second instance would be enough to take someone to jail, as happened with Lula. The rapporteur of the PEC, deputy Fábio Trad, from (PSD-MS), asks again to hurry. “It is important for the country, it fights impunity and, above all, it asks for agility from the justice system. My expectation is that the Plenary of the Chamber of Deputies will meet soon so that we can approve this PEC. First, however, the special committee must approve it. Today, expectations are positive, but without popular pressure, unfortunately, nothing will happen”, he said.

Like the rapporteur Fabio Trad, the author of the PEC charges his colleagues for a position. Deputy Alex Manente (Cidadania-SP) assesses that without popular pressure the project will be shelved. “It is necessary for society to mobilize, to pressure the Chamber of Deputies to deliver this important response to combat corruption, especially the impunity of the rich and powerful, approving PEC 199”, he analyzed. Alex Manente adds that the PEC of the second instance prison will bring a new legal order on the matter to the country. The project, if approved, does not provide for retroactivity, which will establish that the measure will only be applied to new processes.
