Mar del Plata: the trial of the three accused of abusing a 14-year-old girl in a Miramar campsite begins

On Mar del Plata the jury trial began on three young men accused of sexually abusing a 14 year old teenager in a Miramar campsite, in 2019, during the New Year celebrations. The process began at 9 o’clock, with the hearing for the selection of the twelve regular jurors and six substitutes that will make up the citizen court and, as of 2 pm, the oral debate will begin, which will last for four days. The verdict is scheduled to be released on Friday the 17th.

During the trial, the members of the jury must decide whether Thomas Jaime (26), Lucas Pitman (24) and Juan Cruz Villalba (25) are responsible for the crime of “sexual abuse with carnal access aggravated by the participation of two or more people”. The three young men are accused of having raped the adolescent in the early morning of January 1, 2019 in a tent of the camping “El Durazno”, located at the entrance to Miramar, where she celebrated New Years with her family.

The trial -which will take place at the Auditorium Theater in order to comply with the sanitary protocols imposed by the pandemic- is in charge of the Oral Criminal Court 3 Mar del Plata, chaired by the judge Fabián Riquert, and the prosecutors Guillermo Nicora and Ana María Caro.

Judge Riquert ordered that the press not have access to the hearings to preserve the victim – who is still a minor – and his family.

At 2:00 p.m., once the members of the popular court have been selected, the debate is scheduled to begin with the preliminary questions, the jury’s oath, the initial instructions to its members and the presentation of the initial lines of work of the parties. . From 15 victims will give testimony.

The young accused will be represented by private defenders: Noelia Agüero, in the Pitman case; Martín Bernat and Agustín Robbio for Jaime, and Marcelo Jiménez for Villalba.

As representative of the young woman and her family, the lawyer Maximiliano Orsini will intervene, who in preliminary hearings asked not to air “personal issues of the victim that have nothing to do with the fact under trial”, a proposal that was accompanied by the prosecution.

The investigation that carried out the prosecutor Florencia Salas established that the accused the adolescent was sexually abused between 4 and 6 on January 1, “taking advantage of the age” of her and what “could not freely consent the actuation “.

Shortly afterwards, the defendants were arrested after the complaint that the girl filed with her mother at the Miramar Women’s Police Station. Later, they were housed in the Penal Unit 44 of Batán until May 3, 2019, when they accessed the benefit of house arrest with electronic monitoring.

The morigeration was without effect days ago, based on a request from the teenager’s family, which requested that they be released from prison to prevent them from continuing to compute time as part of an eventual sentence.

The three defendants denied at the time of their inquiries that there had been sexual abuse.
