The Spanish Association of Commercial Broadcasting (AERC) has been aware of the amendment number 85 presented by the Socialist Parliamentary Group in the Senate to the Draft Law modifying Royal Decree-Law 17/2020, of May 5, by which approves measures to support the cultural and tax sector to face the economic and social impact of COVID-2019, which is scheduled to be voted on in the plenary session of the Senate next Wednesday, September 15, 2021, at 09:00 hours.
The AERC is the national association that groups together practically all commercial radio stations in Spain, from large networks such as SER, Onda Cero, COPE or Kiss, to a multitude of small and medium-sized local and regional stations.
The AERC regrets that, in order to undertake such a far-reaching reform on the methodology of the rates of the entities for the management of intellectual property rights, an issue of the utmost relevance in the sector of collective management, and of special interest to both the entities as for users (radio stations, television organizations, universities, educational centers, theaters, cinemas, town halls, museums, archives, libraries, etc.), a way as unorthodox as is the presentation of a amendment in the Senate to a bill processed through the emergency procedure that, furthermore, is not related to the matter.
This way of proceeding deprives the sectors concerned of the possibility of participating in a public consultation or public information process. AERC has the firm belief that, in a matter so sensitive and that has given rise to so many conflicts, such as that of the fees of the management entities, the modifications should be channeled through the ordinary legislative procedure, and in a debate full and calm parliamentarian in both houses.
The Spanish Association of Commercial Broadcasting has addressed all the parliamentary groups and the affected Ministries expressing its concern about the untimely way of tackling this problem and the proposed solutions, sending the allegations and corrections to the project that in its opinion should be made. The AERC has not been consulted on the advisability of the intended modification.
