The Federal Criminal Cassation Chamber He again rejected a new proposal from Gerardo Morales, governor of the province of Jujuy, and certified that the sentence of three and a half years in prison against Miracle Room for “aggravated damage and coercive threats” that a court imposed on him this year during the electoral campaign in Jujuy. This is for the known cause called: “Los Huevazos”.
This past year, judges Mario Juárez Almaraz, Alejandra Cataldi and María Liliana Snopek took up the court file together with the public orders for conviction and jail for those who are currently in house arrest. His defense was presented to raise the statute of limitations, but the court rejected it. Finally, on June 17, it was decided to impose a sentence of three and a half years.
The leadership returned to the Cassation Chamber and with another composition, Chamber IV signed a sentence stating that the Jujuy court had “invented non-existent reasons” in the procedural rules to consider the prescription interrupted and prosecute the Chamber. Judge Ledesma, in her vote, added previous irregularities such as the fact that Salvatierra was not allowed to appoint her defender and one was imposed on her. Judges Carbajo and Catucci agreed, but said that the file should return to the oral court to issue a new ruling.
Finally, this is what Morales wanted to avoid since Cassation continues to reject his proposals regarding the final sentence. Although the governor could go to exercise his complaint to the Court, the logic would be for the oral court to issue a new ruling.
This distinguished cause called: “Los Huevazos”, originated in 2009 when a protest was held against the governor who, at that time, was a senator; while giving a talk at the Professional Council of Economic Sciences. The politician received “balls” from people who were in opposition to his policy. Milagro Sala, leader of the Túpac Amaru (neighborhood organization and political group), had not been part of that event, however, she was accused as an “instigator”.
Despite the fact that the file began in 2009, the oral trial only took place in 2016, when, on December 28, Milagro Sala was sentenced to three years in prison. As co-authors, the court also involved Graciela López and Ramón Salvatierra. The reason she was convicted without having been present at the event is because a witness named René Arellano, an employee of Morales, said that everything was planned at her home.
