Deutsche Post offers various options for customers who are expecting a parcel but cannot be at home on the day of delivery. One of them is parcel delivery to a neighbor, whereby you can even specify an explicit neighbor.

This is a pretty practical service for Deutsche Post customers. Neighbors seem to have less of a say here, however.

Deutsche Post reacts to the complaint – what is the legal situation here?

“If your neighbor has registered you as a desired neighbor in his personal data on, only he can remove this information / data again,” Deutsche Post explains to the angry woman on Facebook.

“Maybe you should talk to your neighbor personally about it and tell him that you don’t want him to have you there as a preferred neighbor and that you should change that again,” suggests Deutsche Post to the customer. But is that really the only option?

The legal situation for neighborly parcel acceptance is regulated in the Post-Universalverordnung (PUDLV) as well as in the Postgesetz (PostG). The legal basis for the processing of the (substitute) recipient data can, however, be found in the General Data Protection Regulation (GDPR). According to the second, strictly speaking, the woman would have to give her consent for her neighbor to list her as a preferred neighbor at Deutsche Post – after all, first and last name and address data are asked for here.

However, the regulations of § 41a PostG allow the processing of personal data to ensure a functioning postal system and are therefore in a special public interest within the meaning of Article 6 (1) (e) GDPR. From a legal point of view, the woman therefore has no other option than to get in touch with her neighbor personally. Incidentally, the Dhl app says on the subject: “Please inform your neighbors that you are entrusting them to receive your shipment”. (Mkx)
