Deutsche Post: Package not arrived – what you have to do now

Many know the nuisance. You have ordered something, but you haven’t received the parcel and you haven’t got a notification in your mailbox either? Your hands are then not tied.

show description

Every day, packages with the German Post delivered. However, if a customer is not at home, the order ends up in the nearest post office or – in the most practical case – with the neighbor next door. But what actually happens when the neighbor totally disagrees with the German postal service in such a case rings his doorbell?

A woman who is visibly outraged by the constant deliveries of parcels from her neighbor is worried about such a question.

Deutsche Post: Woman upset that THAT can happen behind her back

Deutsche Post offers various options for customers who are expecting a parcel but cannot be at home on the day of delivery. One of them is parcel delivery to a neighbor, whereby you can even specify an explicit neighbor.

This is a pretty practical service for Deutsche Post customers. Neighbors seem to have less of a say here, however.

This is the Deutsche Post DHL Group:

  • Postal and parcel service providers as well as providers of international express, forwarding, e-commerce and supply chain management services
  • Group with around 550,000 employees in 220 countries who deliver your letters and parcels to the right address
  • 66.8 billion euros in sales in 2020
  • Practical: you can easily find your shipment using the shipment tracking
  • If you move, you can set up a forwarding order

“Why is my neighbor allowed to specify me as a preferred neighbor without my wanting to? Or let alone take it out again? ”A woman on Facebook wants to know from Deutsche Post.

“Unfortunately, Swiss Post does not respond to numerous e-mails,” writes the angry lady. “An absolute cheek. Every time my child rings the bell. I’ll be putting the bell under power soon. “

Deutsche Post reacts to the complaint – what is the legal situation here?

“If your neighbor has registered you as a desired neighbor in his personal data on dhl.de, only he can remove this information / data again,” Deutsche Post explains to the angry woman on Facebook.

“Maybe you should talk to your neighbor personally about it and tell him that you don’t want him to have you there as a preferred neighbor and that you should change that again,” suggests Deutsche Post to the customer. But is that really the only option?

Deutsche Post is facing a major challenge – it has never been done before!

The legal situation for neighborly parcel acceptance is regulated in the Post-Universalverordnung (PUDLV) as well as in the Postgesetz (PostG). The legal basis for the processing of the (substitute) recipient data can, however, be found in the General Data Protection Regulation (GDPR). According to the second, strictly speaking, the woman would have to give her consent for her neighbor to list her as a preferred neighbor at Deutsche Post – after all, first and last name and address data are asked for here.

However, the regulations of § 41a PostG allow the processing of personal data to ensure a functioning postal system and are therefore in a special public interest within the meaning of Article 6 (1) (e) GDPR. From a legal point of view, the woman therefore has no other option than to get in touch with her neighbor personally. Incidentally, the Dhl app says on the subject: “Please inform your neighbors that you are entrusting them to receive your shipment”. (Mkx)
