Munich. Ironically, a judge of the Higher Regional Court Munich was now in court as a defendant.

Claus P. (59) was caught with over 4000 child porn! The investigators were amazed when they found out where the material came from. Now the verdict against the judge has been passed.

The 59-year-old was a high-ranking judge at the Higher Regional Court Munich. But the time is over. Investigators found a huge collection of child porn at Claus P., which he had obtained from the Darknet but also from criminal files. For this he has now been sentenced to a fine.

As several media reported unanimously, the investigations against the judge began in May 2020. Accordingly, there had been indications from abroad. In a subsequent search in June 2020, investigators found extensive evidence. IT forensic scientists were busy evaluating it for months.

“In the course of these evaluations, the suspicion was confirmed”, quoted the “Süddeutsche Zeitung”, Thomas Goger, senior public prosecutor of the Bamberg Public Prosecutor’s Office, who had conducted the relevant investigation. Because Claus P. abused his position as a judge, he was convicted not only of possession but also of procuring child pornographic content himself.

“This procedure also proves that the perpetrators of child pornography offenses come from all walks of life,” says Chief Public Prosecutor Goger. The procedure shows that no one can be sure of being permanently safe from exposure in the supposed anonymity of the Darknet.

Munich: defendant escapes prison sentence

The penalty order was applied for in June 2021 and has been in force since the beginning of July. The 59-year-old got away with a blue eye: 150 daily rates at 30 euros each, i.e. 4500 euros. The reason why the verdict was so low was that he had already voluntarily resigned from the judicial service. The daily rates depend on the current net income. The job loss, the unpunished past life and his confession had a positive effect on Claus P’s judgment.

On the other hand, the former judge was at the expense of the large number of child pornographic images and videos, as well as the type of content presented and the abuse of his professional position.

The low penalty is also related to a change in the law: Since July 1st, such acts are no longer considered a crime but an offense. Otherwise Claus P. would have received a prison sentence of at least one year. (nk)
