The Government has modified the draft of the new audiovisual law to allow RTVE financing is made with contributions from the platforms and audiovisual market agents, both free-to-air or pay-TV, video on demand providers and platforms.

The Ministry assures that by modifying the RTVE financing law “a further step is taken to establish a balanced playing field for all the players in the sector and that they all have the same obligations. “

At the same time, the Executive has decided to eliminate direct contributions from telecommunications operators for the non-audiovisual business part, another of the new features incorporated.

There will be new sources of income for RTVE that you can “monetize” advertising through sponsorships or advertisements on international channels and digital content; and it can also be inserted into the corporation’s channels on video exchange platforms.

In order to promote European audiovisual work, various obligations are included that maintain this precept already established in the first draft, and that affects “streaming” platforms such as Netflix or HBO.

They will have to allocate 3.5 percent to audiovisual work by an independent producer in official languages ​​of Spain, 0.9 more than the current percentage; and they will also have to allocate 2 percent of the investments to finance independent cinema in Spanish or the co-official languages of the autonomies.

It also aims to contribute to reducing the gender gap and for this it establishes measures to respect equality and non-discrimination for gender reasons, with self-regulation codes that protect users from content that violates the dignity of women or encourages discrimination. Audiovisual works directed or created exclusively by women are promoted.

And in terms of content, the supply of accessible content prevails, with a higher percentage that must be guaranteed by the so-called “providers”, including those of linear pay television and on-demand services.

Likewise, it seeks to protect minors with reinforced protection schedules in the afternoon, Advertising of alcoholic beverages is prohibited from targeting minors and is presented as a fact for “social or sexual success” and is related to encouraging ideas of personal, family, sports or professional success.

The hourly limitations for advertising these drinks, when they are less than 20º, remain as they are now, only allowed from 20.30 to 5.00, while those with the highest graduation range from 1.00 to 5.00 a.m. dawn, as well as gambling, esoteric and para-science broadcasts.

The Ministry of Economic Affairs recalls that this new regulation transposes a 2018 European directive on audiovisual communication into the Spanish legal system and analyzes the current market situation, with new agents and services.

It also points out that the novelties included in the new draft are due to a “intense consultative process with the different public agents involved” following his first submission to a public hearing last October.
