The Government finalizes the draft law for the effective equality of trans people and LGTBI equality, a text that expected to approve the Council of Ministers on June 29 and that it will allow the change of sex and name in the Civil Registry without the need for witnesses, evidence or reports within a period of three months.

Negotiations between the different departments involved (Equality, Justice and First Vice Presidency) continue, the text has not yet been closed, knowledgeable sources explain, but there is agreement on the change in the registry of sex, the main obstacle in the elaboration of the norm.

With the future law no reports will be needed doctors, no witnesses, or evidence for a trans person to modify the mention of sex and his name from the age of 14, as El Periódico has advanced and sources familiar with the negotiation have confirmed to Efe.

Legislation will thus end the pathologization of trans people and will recognize their identity exclusively with a simple administrative procedure in the Civil Registry: the interested person will express their will to the official and will do it again three months later for the change to be effective.

In the last draft of the preliminary draft, he looks at the 14 years the age from which a minor can change their sex and name in the Civil Registry. The LGTBI groups asked that it be placed at 12 years.

The registration change procedure will be simple: the interested person must go to the Registry with a prior appointment and fill out a form in which they indicate that they are not satisfied with the sex assigned to them at birth and request that it be rectified, as well as the change of name.

The Registry officer will inform you of the legal consequences of this rectification and it will provide you with information on support resources and rights protection associations that you can turn to if you wish.

Within a period of three months, the trans person will be cited again by the Registry to ratify your decision, at which point the change of name and sex will be effective.

Finally, after months of blockade, the Government will approve a single law in the week of LGTBI Pride that brings together the contents of the trans and LGTBI laws outlined by the ministry of Irene Montero.

Moncloa sources have clarified that it continues working “quickly” in the text so that “it has the legal certainty it requires” and does not clash with the existing legislation and they have added that the groups have been listened to for its elaboration.
