A judge has sentenced the owner of a dog and the person in charge of a canine residence to six months in prison and two years of disqualification for any trade related to animals, in addition to prohibiting them from having pets, for neglecting a dog for two months in an “unacceptable” way until it was in a “deplorable” state.
In the sentence, the head of the criminal court number 1 of Terrassa (Barcelona) imposes on NJC, owner of a canine residence in Sant Cugat del Vallès (Barcelona), and SQJ, in charge of the center, the penalty requested by the specialized Prosecutor’s Office in Environment for a crime of animal abuse.
An old woman who could no longer take care of her dog He delivered it in December 2016 to the Sant Cugat kennel, where he stayed for two months, a period in which, according to the sentence, the two defendants did not “intentionally” provide the animal with the “minimum essential” care regarding its diet and veterinary treatments.
The owner definitively renounced the possession of her dog on February 1, 2017, at which time the dog was delivered to the Barcelona City Council animal shelter, when it was already very thin, dehydrated, foul-smelling, knotty limbs and he suffered from a severe eye infection that prevented him from opening his eyes.
According to the sentence, the “sorry” state of the dog when he was handed over to the Barcelona municipal reception center, after two months in the accused’s kennel, it is “unacceptable”, since he was in a “deplorable” situation.
The judge considers “implausible” the exculpatory version offered at the trial by the owner and the manager of the kennel, who alleged that it was a “problematic and aggressive” dog: “nothing justifies the serious omission made by both defendants.”
For this reason, the judge considers the penalties requested by the Prosecutor’s Office “adequate and proportionate” and imposes on both a six-month prison sentence for animal abuse, as well as the disqualification for two years from the exercise of any profession, trade or trade related to animals, as well as for keeping pets.
