Her defense alleges that the motive for which this mother from Maracena (Granada) committed the crime “is understandable from the human point of view, since she only intended to protect her children. “As a victim of gender violence, she receives adequate attention from the municipal services of Maracena, a town where she is loved and valued by her neighbors,” according to a statement.

He emphasizes that, in fact, more than 400,000 people and 54 entities from different fields have shown their support for the petition for pardon for Juana Rivas, who has collected enough funds to satisfy Civil Liability, which has already been made available to the private prosecution in the procedure.

The defense of Rivas also maintains that the Italian justice continues to investigate the complaints filed for family violence and “there is a civil procedure on the custody of children currently underway, in which a new expert test is being carried out on the minors.”

Juana Rivas has been sentenced after she traveled to Spain with her two children in May 2016 and did not return to Carloforte (Italy), where she had been living with her then partner for three years. On August 2, he informed him that he was not going to return to Italy and he schooled the children in a school in Maracena (Granada).

The parent, who had the custody and provisional custody of the two minors, denounced the facts and a Court of First Instance of Granada agreed to the immediate return of the minors to Italy as the State of habitual residence of the two children. After several requests for him to return his children, on July 26, 2017 Rivas went into hiding with them, and his ex-partner denounced the disappearance. Juana Rivas handed over the two children a month later, on August 28, 2017, at the Granada Civil Guard Command.
